Product Liability

Eau Claire, Wisconsin Product Liability Lawyers

The manufacturer of a product has a duty to produce a product that is safe and will not create an unreasonable risk of injury when used in a foreseeable manner. If you have been injured by a defective product, you may have a claim against the product's manufacturer and distributors. At Herrick & Hart, we represent adults and children in northwestern Wisconsin, including Eau Claire, Chippewa Falls, Menomonie, Hudson, Rice Lake, Superior, Wausau, LaCrosse, and everywhere in between, who have been injured by:

  • Unsafe children's toys, car seats or cribs
  • Machinery and equipment used in a factory, such as presses and conveyors
  • Unsafe electric saws, drills, nail guns, and any other power tools
  • Defective heaters, fireplaces or furnaces
  • Defective car seatbacks, seat belts, air bags or door locks
  • Defective snow blowers
  • Defective cigarette lighters
  • Defective farm equipment and machinery
  • Poorly designed recreational vehicles such as all-terrain vehicles (ATV)
  • Unsafe lawn mowers and gardening equipment
  • Dangerous toasters, ovens, and other household appliances
  • Lemon law claims

A product is considered unreasonably dangerous when it is dangerous beyond what might be expected by the ordinary user. A product may be defective either by reason of manufacture or design if it is unsafe for normal use. Product liability claims can be based on negligence, strict liability, or breach of warranty. More information about product liability law can be found in the FAQs included on this website. Product liability claims can be made against the manufacturer, distributor, wholesaler, retailer, and maker of component parts.

We offer a free initial consultation for product liability victims. We also handle all product liability claims on a contingent fee basis. You only pay attorney fees on successful conclusion of your case. If there is no recovery, you are not responsible for any attorney fees.
