When Your Child is Injured in a Car Collision

September 2026

All parents wish to protect their children.  Sadly, many children are hurt in car collisions. The best way for a parent to protect their child in a car is to put them in a child safety seat.  The parent should follow all of the instructions for the safety seat.  The parent should also follow safe driving practices while on the road.

A child is more vulnerable to injuries from a car collision since they have a larger head to body ratio.  In addition, they have a weaker head and spine as compared to an adult.

If a child is injured, they have the same right to bring a claim in court for compensation.  The process for a minor is different from an adult in that a guardian ad litem will be required.  A guardian ad litem is appointed by the court to represent the best interests of the child.  They will assist the lawyer that you hire on the case.  Different time limits also apply in Wisconsin for cases brought by a minor.
