Dealing with Insurance Adjusters After a Collision

The moments and days after a car collision are often filled with stress, physical pain and anxiety.  During this time, insurance adjusters are assigned to investigate the collision.  First, you should understand that the insurance adjuster is a professional employed by the insurance company to investigate the claim.  Although they may seem friendly and emphathetic to your situation, they are not your advocate.

You have a legal obligation to cooperate with your own insurance company.  This duty of cooperation is found written in your insurance policy.  You may need to cooperate with your own insurance company to obtain benefits like medical payments coverage or uninsured motorist coverage.  You should keep this conversation brief and stick to the basic facts of the incident.

For the opposing driver's insurance, you have no duty to cooperate and and not required to give a statement.  You should politely decline to give a statement.  These statements will be analyzed and used to discredit you and devalue your claim.
