The unfortunate reality of ATV/UTV use is the serious injuries that are caused when they are involved in a collision.  At Herrick & Hart, we have worked on cases involving those injured due to the negligent use of an ATV/UTV.

A common causue of ATV/UTV collisions is following too close.  This occurs when the driver in front slows down and the driver behind does not notice soon enough and rear ends the ATV/UTV in front.  Many factors can cause the driver to slow down in front that include an object in the trail, an uneven trail, an unrepaired trail or animals in the trail.  Visiblity may also be compromised as well due to the dust that is created on the dirt trails by the vehicles.

Additionally, collisions can occur when the trail crosses over a road.  In this situation, both the driver on the road and the ATV/UTV driver need to be aware of any signage that requires them to stop and be aware. 

In another scenario, ATV/UTV's have hit head on.  This happens due to their not being a centerline on the ATV/UTV trail.  This is especially dangerous when the vehicles meet at the crest of a hill.  A driver from both sides of the hill may not realize another driver is approaching form the other side.
